GENERAL CONDITIONS OF THE PORTAL

Introduction

For the purpose of these terms and general conditions of use of the portal, the term “User” shall be understood as anyone who may access the portal through any means. These terms and general conditions regulate the use of (including mere access to) portal web pages, and therefore also to content and services that SUÁREZ makes available to the portal user ( “General Conditions”, “Contents” and “Services” ”). Some content and services may also be regulated under specific conditions and in case of conflict, will be prevailed under General Conditions (“Specific Conditions””). Likewise, each time a user uses relevant Content or Services, relevant Specific Conditions shall apply.

BY CONSEQUENCE, THE USER MUST CAREFULLY READ THE TERMS AND CONDITIONS EACH TIME HE VISITS THE PORTAL AND WHEN NECESSARY, THE RELEVANT SPECIFIC CONDITIONS EACH TIME CONTENT OR SERVICES ARE USED.
In any case, SUÁREZ reserves the right to modify, at any time and without prior notification, the layout and configuration of the portal, as well as General Conditions or relevant Specific Conditions.

Use of the Portal

Unless otherwise stated under Specific Conditions, the mere use of the Portal is free of charge, without detriment to connection charges of the users own telecommunications network in order to gain access.

The user acknowledges and accepts, voluntarily and expressly, that in all cases the use of the portal is under his sole responsibility.

In using the portal, the user agrees to not perform any conduct that may (i) violate the law and/or General Conditions or Specific Conditions or (ii) damage the image, interests and rights of SUÁREZ or of any third-parties, or that may damage, disable or overload the portal, or that impede or alter in any way the normal use of the portal. In particular, the user expressly agrees to (i) not destroy, alter, disable or otherwise damage data, programs or electronic documents and other information found on the Portal; and (ii) not introduce programs, viruses, macros, controls or any other type of logic device or character sequence that may cause or likely cause any alteration in the portal’s computer system or of third parties.

SUÁREZ adopts reasonable security measures that are adequate to detect the presence of viruses. However, users must be aware that security measures of their computer whilst on the Internet are not entirely reliable and therefore SUÁREZ can not guarantee the absence of viruses, malicious software, worms, third party social engineering attacks (phishing, pharming, Trojans, etc.) or other elements that may cause computer (software and hardware), electronic document and file alterations.

Access to the portal is forbidden to mechanized systems (differing from the access of individuals), as these cause damage to SUÁREZ as it can not objectively measure its audience.

SUÁREZ excludes liability that may arise through no fault of SUÁREZ of (i) interference, omissions, interruptions, computer viruses, telephone faults or disconnections of the operation of the electronic system; or (ii) delays or blockages in the operation of the electronic system caused by telephone line of Internet deficiencies or overloads, as well as damage caused by third parties.

SUÁREZ is authorized to temporarily suspend, without prior notification, access to the portal due to maintenance, repairs, updates or improvements.

Intellectual and industrial property Rights

All content (including the graphic design, source code, logos, text, graphics, illustrations, photographs, names, trademarks or distinctive symbols and any other elements that appear on the portal), is owned exclusively by SUÁREZ or third parties, unless otherwise stated.

The user is not granted any intellectual or industrial property rights on the portal or any of its components and therefore the use is strictly prohibited from the reproduction, transformation, distribution, public communication, making available, extraction, reusing, resending or use of any nature, means or procedure, except in cases in which it is legally permitted or authorised by the copyright holder.

The user may view and obtain a temporary private copy of the contents exclusively for personal, private and non-commercial use on their computers (software and hardware), provided that the intended purpose isn’t for the purpose of developing collective, commercial or professional activities. The user mustn’t obtain or attempt to obtain, content through various means or procedures which have been made available or indicated for that purpose or those which are frequently used on the Internet (provided that the latter do not imply a damage risk or uselessness of the portal). The user must respect at all times all portal intellectual and industrial property rights owned by SUÁREZ or third parties.

Hyperlinks

The user and in general, any individual or legal entity who intends to provide a hyperlink or technical link device (such as, links or buttons) from its web site to the portal (the "Hyperlink") must obtain previous written authorisation from SUÁREZ.

The insertion of the hyperlink shall in no event imply the existence of any relationship between SUÁREZ and the owner of the site or the web page where the hyperlink is inserted, or the acceptance or approval by SUÁREZ of its contents and services.

In any event, SUÁREZ reserves the right to prohibit or cancel with no prior notification any hyperlink to the portal, especially in circumstances where the activity or contents of the web site where the hyperlink has been inserted are unlawful.

Linked sites

The portal makes available to the user, solely for the purposes of searching and accessing information, contents and services available on the Internet, hyperlinks or technical link devices (such as, links or buttons), which allow users to access internet sites or portals which belong to or are managed by third parties (the “Linked sites”).

SUÁREZ does not offer or market itself through third parties, information, content or services available on Linked Sites, nor does it approve, supervise or control in any way whatsoever the contents or services or any material of any nature available on Linked Sites, and thus the user shall be exclusively responsible for the navigation between said sites.

Personal Data

Personal data provided by users on the portal shall be processed (and, where appropriate stored on the server) of which SUÁREZ is held responsible.

Unless otherwise stated on the portal’s forms where data is collected, the collection and processing of personal data is to:

(i) manage and control user compliance of these General Conditions and Specific Conditions (i.e. the conditions of Contents and Services which are accessed through this portal such as the purchase agreement of our products, databases of our online draws in which you participate in, conditions of sending your CV, etc.); and

(ii) ) if authorised by the user (e.g. by checking a box which appears on data forms completed on this portal), to receive invitations or information regarding SUÁREZ activities (i.e. jewellery products or services relating to the jewellery sector), using provided data (including by electronic means).

Data requested by the user on retrieval forms shall be obligatory unless otherwise stated on the relevant form. In the event that the user does not provide required data, SUÁREZ will not be able to process the form in question. By entering personal data, the user guarantees SUÁREZ that said data is correct, truthful and refer only to the user and not third parties.

Children under 18

This portal is not directed at children under 18. IF YOU ARE UNDER 18 DO NOT USE THIS WEBSITE AND DO NOT PROVIDE ANY DATA ABOUT YOURSELF OR ANY OTHER PERSON (NOR FRIENDS, FAMILY ETC.)

Our cookies

We use cookies, a data set that identifies a user during a live session, known as “session”, which means that cookies are memorised and are only valid for the duration of an active session, i.e. during your visit to the portal. These cookies do not permanently store any information on your computer’s hard drive and expire at the end of the session.

Generally, cookies that collect certain user information are not used on the portal. On the online store process of our website, cookies do not collect information about the user’s browser, but only the user’s session ID during access to the website in order to process the purchase (in particular, bank reconciliations) and also to verify data input.

In general, cookies we use are only associated with an anonymous user and your computer and do not provide references that allow the user’s name or surname to be identified. Regarding online store transactions in particular, data submitted by the user during the purchase process will be associated with the session ID for bank reconciliations and to finalise the purchasing process.

The user can freely decide whether or not to store our cookies on their hard drive as well as deleting them, following steps on the help section of their browser. The user may also configure their browser to accept or reject by default all cookies or receive a warning before accepting cookies and decide at that time whether to allow them to be stored on the hard drive.

If a user decides to configure their browser to reject all cookies or expressly reject our cookies, the portal experience may be slower or cause problems.

Applicable law

These General Conditions are governed by Spanish Law.
