GENERAL CONDITIONS

1. General purchase conditions

These Specific Purchase Agreement Conditions apply to online sales made through the joyeriasuarez.com website (hereinafter, the ONLINE BOUTIQUE), owned by Suarez Training (hereinafter SUAREZ).

Suarez Training is a limited company with registered office at c/ Gran Vía 40 bis 3, 48009 Bilbao, with tax identification number B 95352936, and SUAREZ is one of its commercial brands.

The client's use of the ONLINE BOUTIQUE's services implies, in any case, acceptance of the Specific Conditions of the national online Purchase Agreement, in the version published by SUAREZ, at the very moment of the purchase order. Therefore, it is advisable for the client to read these Specific Conditions before making a purchase, as well as the general terms and conditions of use of the portal.

In all matters not provided for in these Specific Conditions of the national online Purchase Agreement, the provisions of the general terms and conditions of use of the portal shall apply.

2. Object of the contract

These specific online purchase conditions apply to the purchase of any product present on the joyeriasuarez.com website.

The possibility of acquiring products on the joyeriasuarez.com website by exchanging shopping vouchers, gift cards and similar acquired at El Corte Inglés and other companies issuing such instruments is expressly excluded.

The prices of each piece of jewelry and accessory are indicated on the website on the date of the order. Prices are detailed for each item and include VAT[1]. The amount of shipping costs and any other service is also specified and will be indicated to the client itemized at the time of placing the order.

The online purchase service through the Portal regulated in these Specific Conditions only allows the purchase of products and services to users over 18 years of age.

SUAREZ reserves the right to cancel a user's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

SUAREZ will modify and update, if deemed appropriate, items and prices based on the company's commercial criteria.

[1]For the Canary Islands, the legally established indirect tax (IGIC) will be applied, which will be detailed prior to shipment.

3. Contracting procedure

Before contracting, the client will have at their disposal in the ONLINE BOUTIQUE information related to the procedures that must be followed for the conclusion of the electronic contract for the purchase and sale of products or services. The online purchase procedure consists of the following phases referred to in the online purchase process:

  1. Purchase
  2. Data form,
  3. Payment
  4. Confirmation
  5. Shipping

SUAREZ will archive the electronic document so that it is accessible to the client at a later time after the conclusion of the Contract. The language in which the contract can be formalized is Spanish.

Finally, during the online purchase process, you will be asked for the data (e.g., delivery address) that are necessary to carry out the execution and control of the purchase (including product delivery and price collection). The billing data will be those recorded in the user's registration. SUAREZ is not responsible for errors made by the client in the data provided for the purchase, and the client must pay special attention to filling in the forms and without prejudice to the possibility of correcting said data after the purchase, when possible, at the following address: Joyería Suarez c/ Serrano 63, 28006 Madrid, or if you prefer, by phone: 917 811 680.

If the client enters erroneous data during the purchase process and its correction leads to expenses, SUAREZ reserves the right to charge said expenses to the user or to cancel the requested purchase.

Likewise, Suarez reserves the right to cancel the order in case of any type of human error in uploading the product to the site, whether in the description of its characteristics, in the price shown on the product sheet or the stock associated with it. In such a case, Suarez will notify the client as soon as possible through the customer service department and will try to offer an alternative solution.

4. Obligations of the parties

Payment

The client of SUAREZ products commits to diligent and good faith use of the portal, to satisfy the established price payment, and is responsible for the veracity of the data provided required for the transaction.

The prices of each piece of jewelry and accessory are indicated on the website on the date of the order and include taxes and fees. The client can choose the payment method at the end of the purchase process from the following:

  • Card payment: all Visa, Mastercard, and American Express credit and debit cards are accepted.
  • Payment by Paypal.
  • Payment in installments with Aplazame financial institution.
  • Payment by bank transfer: it will be made by the client's bank to the SUAREZ account indicated on the checkout page, then sending the receipt to atc@joyeriasuarez.com. Once the payment is confirmed by the administration department, the product will be shipped.

For the payment process, SUAREZ uses third-party services unrelated to SUAREZ and, in particular, those of the BBVA financial institution's PAYMENT GATEWAY (an online payment gateway, which functions as a virtual point-of-sale terminal). Service providers will request certain data from the client to make the payment, according to the payment methods they offer. Once the payment process (step 3 of the online purchase process) is successfully completed, the contract will be understood to have been concluded and SUAREZ will confirm such contracting by email within a maximum of 24 hours.

Delivery

Unless expressly stated otherwise during the online purchase process, the procedure for delivering the SUAREZ product or service acquired through the Service to the client will be carried out according to the following steps:

  • The shipment will be made to the address indicated by the client during the purchase process, as completed in step 2 (Data Form).
  • The shipment will be made through a courier service provided by a third party unrelated to Suarez.

SUAREZ undertakes to deliver the product paid for by the client to the delivery address within 5-7 working days, although for reasons beyond the company's control, it may take longer. If it is a new piece, the delivery time can be up to 16 weeks for production.

If there is any problem in the processing of your order or in the shipment, SUAREZ will contact the client to inform them of the incident. In any case, the client can also contact SUAREZ to check the status of their order and shipment at the following address atc@joyeriasuarez.com and phone number: 917 811 680.

Unless expressly stated otherwise during the online purchase process, the shipping costs of the SUAREZ product or service acquired through the Service will be fully borne by SUAREZ.

5. Withdrawal and return

The client has the right to withdraw from the contract for all online purchases within THIRTY (30) calendar days following receipt of the item.

To formalize the withdrawal, the client may use any of the following methods:

  1. Contacting our Customer Service department via email atc@joyeriasuarez.com, indicating the order number and postal address for product collection. Our Customer Service department will send you a label that you must print and place visibly on the package.
  2. Depositing the jewel in any of our physical boutiques.
  3. Requesting the return in the SUÁREZ client area on the website itself.

Once the withdrawal is formalized and the item returned along with its original packaging, if the right of withdrawal is exercised within the first 15 calendar days following receipt of the item, the purchase amount will be refunded using the same payment method used in the purchase and as soon as possible, and in any case, within fourteen calendar days following the moment SUAREZ became aware of the client's withdrawal.

If the withdrawal is formalized after the first 15 calendar days following receipt of the item, the purchase amount will be refunded in the form of a voucher, which will not have an expiration date.

Online purchases do not accept changes in the model of the jewel, only money refunds with the original payment method or in the form of a voucher under the conditions indicated above.

Returns will not be accepted if the jewel has already been modified, i.e., size adjustments different from the standard size 13 and jewel engraving.

6. Existence of warranty

SUAREZ offers its clients products and services of the highest quality.

The gold used for the manufacture of the pieces is 750 thousandths of first law, silver 925 thousandths of first law, platinum 950 thousandths of first law.

The Suárez family, GIA certified gemologists, directly purchases diamonds at their origin. Suárez diamonds in solitaires over 0.20 carats are accompanied by their IGI or GIA certificate. All of them comply with the conditions of the "Kimberley Process" (certification system for the international trade of non-conflict diamonds).

Given the special characteristics of the products marketed by SUAREZ in the ONLINE BOUTIQUE, there are slight differences between each product or service acquired, due primarily to the singularity and exclusivity of each and every one of the materials and stones used in its manufacture, which is, moreover, largely artisanal. Therefore, no two SUAREZ products are exactly alike and, in any case, it is inevitable that the product delivered to the client will differ slightly from that shown in the photographs included in the ONLINE BOUTIQUE purchase process (even if it were the same). In no case will these differences imply the delivery of products or services with poorer quality materials than those expressly mentioned on the Portal.

In any case, notwithstanding the provisions at the beginning of the section, SUAREZ products acquired by the client through the purchase procedure established on the website have the legal guarantee inherent to consumer goods, that is, their conformity with their description on the website and with these Specific Conditions.

SUAREZ is liable for any lack of conformity that becomes apparent within two years from delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this period will not entail the loss of the right to the corresponding remedy, with the client, however, being responsible for any damages or losses actually caused by the delay in communication. In any case, the guarantee relating to defects caused by improper use, as well as generally all those excluded by current European Union legislation, is excluded.

7. Customer service

Purchasers of SUAREZ products can address their complaints and claims to the following address: atc@joyeriasuarez.com or Joyería Suárez, c/ Serrano 63, 28006 Madrid.

Competent jurisdiction and applicable law

For any dispute arising from this online sales contract, the Spanish courts will be competent. Likewise, Spanish law (Consolidated Text of the General Law for the Defense of Consumers and Users) will apply in all matters not provided for in this contract.

SUAREZ is not affiliated with any association or organization that offers an out-of-court dispute resolution system.

8. Intellectual and industrial property

All contents (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, brands or distinctive signs and any elements that appear on the Portal), unless expressly stated otherwise, are the exclusive property of SUAREZ or third parties.

No intellectual or industrial property rights over the Portal or any of its component elements are transferred to the client, with the client being expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, re-sending or using in any way, by any means or procedure, any of them, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.

The client may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature. The client must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those that have been made available or indicated for that purpose in each case, or those commonly used on the Internet (provided that the latter do not entail a risk of damage or disablement of the Portal). The client must at all times respect all intellectual and industrial property rights over the Portal, owned by SUAREZ or third parties.

In any case, SUAREZ reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the General Conditions or the corresponding Particular Conditions.

9. Availability of the online purchase service

The online sales service will be permanently available twenty-four (24) hours a day, although customer service is available from Monday to Friday from 9:00 a.m. to 6:00 p.m. SUAREZ informs the buyer that anomalies or interruptions in the availability or operation of the Service may occur due to causes not attributable to SUAREZ (technical problems of internet providers, telecommunications, problems with the buyer's terminal, etc.), so the period for making the purchase may be extended.
