GENERAL CONDITIONS

1. General conditions of purchase

These Specific Conditions of the Purchase Contract apply to online sales made through the website joyeriasuarez.com (hereinafter, the ONLINE BOUTIQUE), owned by Suarez Training (hereinafter SUAREZ).

Suarez Training is a limited company with registered office at c/ Gran Vía 40 bis 3, 48009 Bilbao, with NIF number B 95352936, and one of its trademarks is SUAREZ.

The customer's use of the ONLINE BOUTIQUE's services implies, in all cases, acceptance of the Specific Conditions of the national online Purchase Contract, in the version published by SUAREZ, at the time of the purchase order. Therefore, it is advisable for the customer to read these Specific Conditions before making a purchase, as well as the general terms and conditions of use of the portal.

Anything not covered in these Specific Conditions of the National Online Purchase Contract must be subject to the provisions of the general terms and conditions of use of the portal.

2. Purpose of the contract

These specific online purchasing conditions apply to the purchase of any product on the website joyeriasuarez.com.

The possibility of purchasing products on the website joyeriasuarez.com by redeeming vouchers, gift cards, and similar items purchased at El Corte Inglés and other companies issuing such vouchers is expressly excluded.

The prices for each piece of jewelry and accessory are listed on the website at the time the order is placed. Prices are detailed for each item and include VAT.[1] Shipping costs and any other services are also specified and will be itemized for the customer when the order is placed.

The online purchasing service through the Portal regulated in these Specific Conditions only allows the purchase of products and services to users over 18 years of age.

SUAREZ reserves the right to cancel a user's account if fraudulent, speculative, or malicious acts are detected in the use of this service.

SUAREZ will modify and update, if it deems appropriate, items and prices in accordance with the company's commercial criteria.

[1]In the case of the Canary Islands, the legally established indirect tax (IGIC) will be applied, which will be detailed prior to shipment.

3. Contracting procedure

Before placing a purchase order, the customer will have access to information on the ONLINE BOUTIQUE regarding the procedures to be followed for entering into an electronic contract for the sale of products or services. The online purchasing process consists of the following stages, which are referred to in the online purchasing process:

  1. Buys
  2. Data form,
  3. Pay
  4. Confirmation
  5. Shipment

SUAREZ will archive the electronic document so that it is accessible to the client after the Contract is signed. The contract may be formalized in Spanish.

Finally, during the online purchasing process, you will be asked to provide the information (e.g., delivery address) necessary to complete and monitor the purchase (including product delivery and payment). Billing information will be the information recorded in the user's registration. SUAREZ is not responsible for any errors made by the customer in the information provided to us for the purchase. The customer must pay special attention when completing the forms. This does not prejudice the possibility of correcting this information after the purchase, when possible, at the following address: Joyería Suarez c/ Serrano 63, 28006 Madrid, or, if preferred, by phone: 917 811 680.

If the customer enters incorrect data during the purchasing process and its correction results in expenses, SUAREZ reserves the right to charge the user for said expenses or to cancel the requested purchase.

Suarez also reserves the right to cancel the order if any human error occurs when uploading the product to the website, whether in the description of its features, the price shown on the product sheet, or the associated stock. Should this occur, Suarez will notify the customer as soon as possible through the customer service department and will attempt to offer an alternative solution.

4. Obligations of the parties

Pay

The customer of SUAREZ products undertakes to use the portal diligently and in good faith, to pay the established price, and is responsible for the accuracy of the data provided for the transaction.

The prices for each jewelry item and accessory are listed on the website at the date the order is placed and include taxes and fees. Customers may choose their payment method at checkout from the following options:

  • Payment by card: All Visa, Mastercard, and American Express credit and debit cards are accepted.
  • Payment by Paypal.
  • Payment in installments with Aplazame financial company.
  • Payment by bank transfer: The transfer will be made from the customer's bank to the SUAREZ account indicated on the checkout page, and the receipt will then be sent to atc@joyeriasuarez.com. Once payment is confirmed by the administration department, the product will be shipped.

For the payment process, SUAREZ uses third-party services outside of SUAREZ, specifically those of the PAYMENT GATEWAY of the financial institution BBVA (an online payment gateway, which functions as a virtual point-of-sale terminal). Service providers will request certain information from the customer to complete the payment, in accordance with the payment methods they offer. Once the payment process (step 3 of the online purchase process) has been successfully completed, the contract will be deemed concluded, and SUAREZ will confirm this agreement by email within a maximum of 24 hours.

Delivery

Unless otherwise expressly stated during the online purchasing process, the procedure for delivering the SUAREZ product or service purchased through the Service to the customer will be carried out in accordance with the following steps:

  • Shipping will be made to the address indicated by the customer during the purchasing process, as completed in step 2 (Data Form).
  • The shipment will be made through a courier service provided by a third party other than Suárez.

SUAREZ is committed to delivering the product paid for by the customer to the delivery address within 5-7 business days, although for reasons beyond the company's control, it may take longer. For new construction, the delivery time may correspond to up to 16 weeks of production.

Unless expressly stated otherwise during the online purchasing process, the shipping costs of the SUAREZ product or service purchased through the Service will be fully borne by SUAREZ.

5. Withdrawal and return

The customer has the right to withdraw from the contract for all online purchases within THIRTY (30) calendar days following receipt of the item.

To formalize the withdrawal, the customer may use any of the following methods:

  1. By contacting our Customer Service department at atc@joyeriasuarez.com , providing the order number and mailing address, we will collect the product. Our Customer Service department will send you a label that you must print and place on the package in a visible location.
  2. By depositing the jewel in any of our physical boutiques.
  3. Requesting a refund in the SUAREZ customer area on the website itself.

Once the withdrawal has been formalized and the item has been returned along with its original packaging, the purchase amount will be refunded using the same payment method used at the time of purchase and as soon as possible, and in any case, within fourteen calendar days from the moment SUAREZ has been informed of the customer's withdrawal.

Online purchases do not accept exchanges for jewelry models; only refunds are accepted using the original payment method.

Returns will not be accepted if the jewelry has already been previously altered, i.e., adjustments to a size other than the standard size 13 and engraving of the jewelry.

6. Existence of warranty

SUAREZ offers its customers products and services of the highest quality.

The gold used to make the pieces is 750 thousandths fine, the silver is 925 thousandths fine, and the platinum is 950 thousandths fine.

The Suárez family, GIA-certified gemologists, purchase diamonds directly from their place of origin. Suárez solitaire diamonds larger than 0.20 carats are accompanied by their IGI or GIA certificate. All diamonds meet the requirements of the Kimberley Treaty (a certification system for the international trade of non-conflict diamonds).

Given the special characteristics of the products sold by SUAREZ in the ONLINE BOUTIQUE, there are slight differences between each product or service purchased, primarily due to the uniqueness and exclusivity of each and every one of the materials and stones used in their production, which is also largely handcrafted. Therefore, no two SUAREZ products are exactly the same, and in any case, it is inevitable that the product delivered to the customer will differ slightly from that shown in the photographs included in the ONLINE BOUTIQUE purchasing process (even if it were the same). Under no circumstances will these differences result in the delivery of products or services with lower quality materials than those expressly mentioned on the Portal.

In any case, without prejudice to the provisions set forth at the beginning of this section, SUAREZ products purchased by the customer through the purchase procedure established on the website are covered by the legal guarantee applicable to consumer goods, that is, their conformity with their description on the website and with these Specific Conditions.

SUAREZ is liable for any lack of conformity that becomes apparent within two years of delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this deadline will not result in the loss of the corresponding right to remedy. However, the customer is liable for any damages actually caused by the delay in notification. In any case, the warranty for defects caused by improper use is excluded, as is, in general, all those excluded by current European Union legislation.

7. Customer service

Competent jurisdiction and applicable law

The Spanish courts shall have jurisdiction over any dispute arising from this online sales contract. Spanish law (the Revised Text of the General Law for the Defense of Consumers and Users) shall also apply to all matters not covered by this contract.

SUAREZ is not affiliated with any association or organization that offers an extrajudicial dispute resolution system.

8. Intellectual and industrial property

All content (including graphic design, source code, logos, text, graphics, illustrations, photographs, trade names, trademarks or distinctive signs, and any other elements appearing on the Portal), unless expressly indicated otherwise, is the exclusive property of SUAREZ or third parties.

No intellectual or industrial property rights over the Portal or any of its constituent elements are transferred to the client. The client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding, or using any of them in any way, by any means or procedure, except in cases where this is legally permitted or authorized by the owner of the corresponding rights.

The client may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that this is not for the purpose of carrying out collective or commercial or professional activities. The client must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available or indicated for this purpose in each case, or those commonly used on the Internet (provided that the latter do not entail a risk of damage or disablement of the Portal). The client must respect at all times all intellectual and industrial property rights over the Portal, owned by SUAREZ or third parties.

In any case, SUAREZ reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the General Conditions or the corresponding Specific Conditions.

9. Availability of the online purchasing service

The online sales service will be available 24 hours a day, although customer service is available Monday through Friday, from 9:00 a.m. to 6:00 p.m. SUAREZ informs the buyer that anomalies or interruptions in the availability or operation of the service may occur due to causes not attributable to SUAREZ (technical problems with Internet providers, telecommunications, problems with the buyer's terminal, etc.), so the purchase process may be extended.
