GENERAL CONDITIONS

1. General purchase conditions

These Particular Conditions of the Purchase Agreement apply to online sales made through the joyeriasuarez.com website (hereinafter, the ONLINE BOUTIQUE), owned by Suarez Training (hereinafter SUAREZ).

Suarez Training is a limited company with registered office at c/ Gran Vía 40 bis 3, 48009 Bilbao, with NIF no. B 95352936, and SUAREZ is one of its commercial brands.

The client's use of the ONLINE BOUTIQUE services implies, in any case, acceptance of the Particular Conditions of the national online Purchase Agreement, in the version published by SUAREZ, at the very moment of the purchase order. Therefore, it is advisable for the client to read these Particular Conditions before making a purchase, as well as the general terms and conditions of use of the portal.

Anything not provided for in these Particular Conditions of the national online Purchase Agreement shall be governed by the provisions of the general terms and conditions of use of the portal.

2. Object of the contract

These particular online purchase conditions apply to the purchase of any product on the joyeriasuarez.com website.

The possibility of acquiring products on the joyeriasuarez.com website by exchanging shopping vouchers, gift cards and similar acquired at El Corte Inglés and other companies issuing such titles is expressly excluded.

The prices of each piece of jewelry and accessory are indicated on the website on the date of the order. Prices are detailed for each item and include VAT[1]. The amount of shipping costs and any other service is also specified and will be indicated to the client in detail at the time of placing the order.

The online purchase service through the Portal regulated in these Particular Conditions only allows the purchase of products and services to users over 18 years of age.

SUAREZ reserves the right to cancel a user's access account if fraudulent, speculative, or bad faith acts are detected in the use of this service.

SUAREZ will modify and update, if deemed appropriate, articles and prices according to the company's commercial criteria.

[1]For the Canary Islands, the legally established indirect tax (IGIC) will apply, which will be detailed prior to shipment.

3. Contracting procedure

Before contracting, the client will have at their disposal in the ONLINE BOUTIQUE the information regarding the procedures to be followed for the conclusion of the electronic contract for the sale of products or services. The online purchase procedure consists of the following phases referred to in the online purchase process:

  1. Purchase
  2. Data form,
  3. Payment
  4. Confirmation
  5. Shipping

SUAREZ will archive the electronic document so that it is accessible to the client at a later time after the conclusion of the Contract. The language in which the contract can be formalized is Spanish.

Finally, during the online purchase process, the data (e.g., delivery address) necessary to carry out the execution and control of the purchase (including product delivery and price collection) will be requested. The billing data will be those appearing in the user's registration. SUAREZ is not responsible for errors made by the client in the data provided for the purchase, and the client must pay special attention to filling out the forms, and without prejudice to the possibility of correcting said data after the purchase, when possible, at the following address: Joyería Suarez c/ Serrano 63, 28006 Madrid, or if you prefer by phone: 917 811 680.

If the client enters incorrect data during the purchase process and its correction leads to expenses, SUAREZ reserves the right to charge said expenses to the user or to cancel the requested purchase.

Likewise, Suarez reserves the right to cancel the order in case of any human error in uploading the product to the site, whether in the description of its characteristics, in the price shown on the product sheet, or the stock associated with it. Should this occur, Suarez will notify the client as soon as possible through the customer service department and will try to offer an alternative solution.

4. Obligations of the parties

Payment

The client of SUAREZ products undertakes to use the portal diligently and in good faith, to pay the established price, and is responsible for the veracity of the data provided required for the transaction.

The prices of each piece of jewelry and accessory are indicated on the website on the date of the order and include taxes and fees. The client may choose the payment method at the end of the purchase process from the following:

  • Card payment: all Visa, Mastercard, and American Express credit and debit cards are accepted.
  • Payment by Paypal.
  • Payment in installments with Aplazame financing.
  • Bank transfer: this will be done by the client's bank transferring to the SUAREZ account indicated on the checkout page, then sending the receipt to atc@joyeriasuarez.com. Once payment is confirmed by the administration department, the product will be shipped.

For the payment process, SUAREZ uses third-party services unrelated to SUAREZ and, in particular, those of the BBVA financial institution's PAYMENT GATEWAY (an online payment gateway that functions as a virtual point-of-sale terminal). Service providers will request certain data from the client to make the payment, according to the payment methods they offer. Once the payment process (step 3 of the online purchase process) is successfully completed, the contract will be deemed concluded, and SUAREZ will confirm such contracting by email within a maximum of 24 hours.

Delivery

Unless expressly stated otherwise during the online purchase process, the procedure for delivering the SUAREZ product or service acquired through the Service to the client will be carried out according to the following steps:

  • The shipment will be made to the address indicated by the client during the purchase process, as completed in step 2 (Data Form).
  • The shipment will be made by a courier service provided by a third party unrelated to Suarez.

SUAREZ undertakes to deliver the product paid for by the client to the delivery address within 5-7 working days, although for reasons beyond the company's control, it may take longer. If it is a new work, the production period can be up to 16 weeks.

If there is any problem in processing your order or shipping, SUAREZ will contact the client to inform them of the incident. In any case, the client can also contact SUAREZ to check the status of their order and shipment at the following address atc@joyeriasuarez.com and phone number: 917 811 680.

Unless expressly stated otherwise during the online purchase process, the shipping costs of the SUAREZ product or service acquired through the Service will be borne entirely by SUAREZ.

5. Withdrawal and return

The client has the right to withdraw from the contract for all online purchases within THIRTY (30) calendar days following receipt of the item.

To formalize the withdrawal, the client may use any of the following methods:

  1. By contacting our Customer Service department via email atc@joyeriasuarez.com indicating the order number and postal address for product collection. Our Customer Service department will send you a label that you must print and place visibly on the package.
  2. By depositing the jewel in any of our physical boutiques.
  3. By requesting the return in the SUAREZ client area on the website itself.

Once the withdrawal is formalized and the item is returned together with its original packaging, if the right of withdrawal is exercised within the first 15 calendar days following receipt of the item, the purchase amount will be refunded using the same payment method used in the purchase and as soon as possible, and in any case, within fourteen calendar days following the moment SUAREZ became aware of the client's withdrawal.

If the withdrawal is formalized after the first 15 calendar days following receipt of the item, the purchase amount will be refunded in the form of a voucher, which will not have an expiry date.

Online purchases do not accept changes to the jewel model, only money refunds with the original payment method or in the form of a voucher under the conditions indicated above.

Returns will not be accepted if the jewel has already been modified, i.e., size adjustments different from standard size 13 and jewel engraving.

6. Existence of guarantee

SUAREZ offers its clients products and services of the highest quality.

The gold used for manufacturing the pieces is of 750 thousandths first law, silver of 925 thousandths first law, platinum of 950 thousandths first law.

The Suárez family, GIA certified gemologists, directly buys diamonds at the place of origin. Suarez diamonds in solitaires larger than 0.20 carats are accompanied by their IGI or GIA certificate. All of them comply with the conditions of the "Kimberley Process" (certification system for the international trade of non-conflict diamonds).

Given the special characteristics of the products marketed by SUAREZ in the ONLINE BOUTIQUE, there are slight differences between each product or service acquired, mainly due to the uniqueness and exclusivity of each and every one of the materials and stones used in their creation, which is also largely handcrafted. Therefore, no two SUAREZ products are exactly alike, and in any case, it is inevitable that the product delivered to the client will differ slightly from that shown in the photographs included in the ONLINE BOUTIQUE purchase process (even if it were the same). In no case will these differences imply the delivery of products or services with poorer quality materials than those expressly mentioned on the Portal.

In any case, without prejudice to what is established at the beginning of the section, SUAREZ products acquired by the client through the purchase procedure established on the website have the legal guarantee inherent to consumer goods, that is, their conformity with their description on the website and with these Particular Conditions.

SUAREZ is responsible for any lack of conformity that becomes apparent within two years from delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this period will not entail the loss of the right to appropriate remediation, although the client will be responsible for any damages actually caused by the delay in communication. In any case, the guarantee relating to damages caused by improper use is excluded, as well as all those excluded by current European Union legislation.

7. Customer service

Purchasers of SUAREZ products can address their complaints and claims to the following address: atc@joyeriasuarez.com or Joyería Suarez, c/ Serrano 63, 28006 Madrid.

Competent jurisdiction and applicable law

For any dispute arising from this online sales contract, the Spanish courts will be competent. Likewise, Spanish law (Consolidated Text of the General Law for the Defense of Consumers and Users) will apply in everything not provided for in this contract.

SUAREZ is not affiliated with any association or organization that offers an out-of-court dispute resolution system.

8. Intellectual and industrial property

All contents (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, brands or distinctive signs and any elements appearing on the Portal), unless expressly stated otherwise, are the exclusive property of SUAREZ or third parties.

No intellectual or industrial property right over the Portal or any of its constituent elements is granted to the client, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, re-sending, or using any of them, by any means or procedure, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.

The client may view and obtain a temporary private copy of the contents for their exclusive personal, private and non-collective use in their computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature. The client must refrain from obtaining, or attempting to obtain, the contents by means or procedures other than those that have been made available or indicated for that purpose in each case, or those that are habitually used on the Internet (provided that the latter do not entail a risk of damage or disablement of the Portal). The client must at all times respect all intellectual and industrial property rights over the Portal, owned by SUAREZ or third parties.

In any case, SUAREZ reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the General Conditions or the corresponding Particular Conditions.

9. Availability of the online purchase service

The online sales service will be available permanently twenty-four 24 hours a day, although customer service is available from Monday to Friday from 9:00 a.m. to 6:00 p.m. SUAREZ informs the buyer that anomalies or interruptions in the availability or operation of the Service may occur due to causes not attributable to SUAREZ (technical problems of Internet providers, telecommunications, problems with the buyer's terminal, etc.), so the period for making the purchase may be extended.
